Clery Crime Definitions
Murder and Non-Negligent Manslaughter: The willful (non-negligent) killing of one human being by another.
Manslaughter by Negligence: The killing of another person through gross negligence.
Robbery: The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear.
Arson: Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, personal property of another, etc.
Liquor Law Violations: The violation of laws or ordinances prohibiting: the manufacture, sale, transporting, furnishing, possessing of intoxicating liquor.
Drug Abuse Violations: Violations of State and local laws relating to the unlawful possession, sale, use, growing, manufacturing, and making of narcotic drugs.
Aggravated Assault: An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury.
Motor Vehicle Theft: The theft or attempted theft of a motor vehicle.
Burglary: The unlawful entry of a structure to commit a felony or a theft.
Weapon Law Violations: The violation of laws or ordinances dealing with weapon offenses such as: manufacture, sale, or possession of deadly weapons; and carrying deadly weapons.
Sexual Assault or Sex Offense: Sexual assault or sex offense is an offense that meets the definition of rape, fondling, incest, or statutory rape as used in the FBI’s Uniform Crime Reporting system. A sexual assault or sex offense is any act directed against another person, without the consent of the victim, including instances where the victim if incapable of giving consent.
- Rape is defined as the penetration of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.
- Fondling is defined as the touching of the private parts of another person for the purposes of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent.
- Incest is defined as non-forcible sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law.
- Statutory Rape is defined as non-forcible sexual intercourse with a person who is under the statutory age of consent.
Hate Crimes: Crimes involving bodily injury to any person in which the victim is intentionally selected because of the actual or perceived race, gender, religion, sexual orientation, ethnicity, or disability of the victim.
Domestic Violence & Dating Violence: Domestic Violence is assault and/or battery of spouse or former spouse, an individual with whom he or she has had a child in common, or a resident or former resident of his or her household with whom they have an intimate relationship. Dating Violence is assault and/or battery in a “Dating relationship”. A dating relationship means frequent, intimate associations primarily characterized by the expectation of affectional involvement. This term does not include a casual relationship between two individuals in a business or social context.
Stalking: “Stalking” means a willful course of conduct involving repeated or continuing harassment of another individual that would cause a reasonable person to feel terrorized, frightened, intimidated, threatened, harassed, or molested and that actually causes the victim to feel terrorized, frightened, intimidated, threatened, harassed, or molested.
